KEY RECOMMENDATIONS MADE BY THE COMMITTEE ON THE STATUS OF WOMEN

 Payment of maintenance to the wife and children must be made mandatory in the event of separation or divorce
 Immediate ban on practice of fatwas (religious decrees)
 Justice through courts to be made accessible and fast
 Complete ban on oral, unilateral and triple talaq

India's Supreme Court has formally opened hearings into a number of petitions challenging the controversial practice of instant divorce in Islam.

The court said it would examine whether the practice known as "triple talaq" was fundamental to the religion.

India is one of a handful of countries in the world where a Muslim man can divorce his wife in minutes by saying the word talaq (divorce) three times.

" India's top court has ruled the practice of instant divorce in Islam unconstitutional, marking a major victory for women's rights activists.

In a 3-2 majority verdict, the court called the practice "un-Islamic".

India is one of a handful of countries where a Muslim man can divorce his wife in minutes by saying the word talaq (divorce) three times.

The landmark court decision came in response to petitions challenging the so-called "triple talaq" custom.
The cases were filed by five Muslim women who had been divorced in this way and two rights groups... "

"Despite the Supreme Court having declared the practice void in August last year, activists on the ground confirm that it continues unabated. Last week the lower house of the parliament passed a bill seeking to criminalise instant "triple talaq". If the bill is voted into a law, men found guilty of divorcing their wives through "triple talaq" could face jail time of up to three years."

Krishna Kohli, 39, is the first-ever Dalit woman to be elected to Pakistan’s Senate.

"Speaking about her main objectives in her new capacity as senator, Krishna, who was married at 16 when she was in 9th grade, said that she wanted to enforce existing laws against child marriage and forced conversion.
“Child marriages and forced conversions are some of the pressing issues which need to be addressed urgently,” she said.
“Many laws have been drafted for the rights of women but none of them have been implemented — something I wish to change,” she said, "

Muslim cleric Mufti Ejaz Arshad Qasmi was arrested Tuesday for repeatedly slapping lawyer Farah Faiz during a live TV debate regarding triple talaq, a banned practice in India that claims Muslim men can divorce their wives by saying, writing or texting “talaq” three times.

Women's group calls for Sharia courts to be banned in India to stop inequality and human rights violations


The Muslim Women’s Quest for Equality (MWQE) has filed an affidavit arguing the courts, which govern marriage, divorce and family cases for India’s 150 million Muslims, should not be allowed to function as a parallel judiciary.
